On May 22, 2026, the Hearing Panel of the College released its Order on Disposition arising from the Panel’s earlier Decision setting out its findings of Professional Misconduct against Dr. Manivasan Moodley. 

The Panel will provide written reasons for its Disposition Order at a later time.

The disposition includes the following components:  

1. Dr. Moodley is reprimanded for his conduct summarized in paragraphs 2 and 4 on pages 75 and 76 of the Decision as follows:
   
   With respect to Patient A, the Hearing Committee has found that Dr. Manivasan Moodley committed professional misconduct by:

• Failing to treat Patient A in a patient-centric manner and, in particular, by failing to obtain her consent to perform an episiotomy in accordance with the College’s Professional Standard and Guidelines Regarding Informed Consent to Treatment, by performing an episiotomy contrary to the expressed wishes of Patient A and by failing to inform Patient A that he performed an episiotomy;
• Manually removing the placenta, which was not clinically indicated, and without providing Patient A with pain relief medication, thereby causing her unnecessary or otherwise avoidable pain and discomfort;
• Providing inaccurate, incomplete or misleading information to the College’s Investigation Committee respecting comments made by staff during the clinical encounter with Patient A; and
• Documenting the care provided to Patient A either inaccurately, incompletely or otherwise contrary to accepted standards.
  
  With respect to Patient B, the Hearing Committee has found that Dr. Manivasan Moodley committed professional misconduct by: 

• Failing to communicate with Patient B throughout the clinical encounter in accordance with accepted standards and misleading Patient B on the probability of another physician performing a tubal ligation in similar circumstances;
• Failing to respect Patient B’s autonomy regarding decisions about her reproductive health by suggesting it was her future husband’s decision as to whether she should have a tubal ligation in the present circumstances and attempting to discourage Patient B from seeking a tubal ligation by negatively focusing the discussion in the clinical encounter in a sexist and paternalistic manner; and
• Interfering with the College’s investigative process by contacting a potential witness in an effort to gain information about Patient B after her complaint was under investigation, contrary to Section 46 of the Medical Act.

2. Dr. Moodley is required to successfully complete the Clinical Skills Training Program developed by the College’s Department of Assessment.

3. The Clinical Skills Training Program shall commence as soon as possible after the Disposition Order and be completed within six months of commencement.

4. Successful completion of the Clinical Skills Training Program will be determined through a comprehensive review by the Program’s physician educator, who will provide a final assessment report indicating whether Dr. Moodley has adequately met the program’s learning objectives.

5. The Hearing Committee reserves its jurisdiction to decide any dispute between the College and Dr. Moodley over the dates for beginning and completing the Clinical Skills Training Program and over whether Dr. Moodley has successfully completed the program.

6. Dr. Moodley’s licence shall be suspended for a period of six months. However, if Dr. Moodley successfully completes the Clinical Skills Training Program, the suspension shall be reduced to four months.

7. Accordingly, the period of suspension shall begin after completion of the Clinical Skills Training Program and shall continue for either six months or four months, depending on his success in the program.

8. Dr. Moodley has completed the Dalhousie Medical Record Keeping Course, so no further order is required to remedy his professional misconduct in documenting the care provided to Patient A.

9. The Hearing Committee reserves jurisdiction over any matters arising from the implementation of the Disposition Order.

In addition, the Hearing Committee has reserved June 25, 2026,  to hear Dr. Moodley and the College address the issue of Costs.
